Porzellan® Professional-Only Product Terms and Conditions Agreement

Welcome to the Porzellan® Professional Portal. By accessing or using the Porzellan® website and purchasing Porzellan products, you (the “Purchaser”) agree to be bound by the following Terms and Conditions. This agreement outlines the terms for purchasing, using, and accessing Porzellan products and materials, which are intended for professional use only.

1. Eligibility for Purchase

1.1 Professional Use Only:
Porzellan® products are intended for licensed healthcare professionals, including dermatologists, plastic surgeons, aesthetic practitioners, or other medical professionals licensed to perform aesthetic treatments. By purchasing, you confirm that you are a licensed professional authorized to buy and use medical-grade aesthetic products.

1.2 Verification:
As part of the account creation and product purchase process, you must provide valid proof of your professional license (e.g., medical license number, board certification) and any required documentation for verification. Porzellan reserves the right to deny access to its portal and products if adequate proof is not provided or if your professional status is not verified.

2. Product Use

2.1 Non-Injectable Product:
Porzellan® is a topical skin glazer designed for use with microneedling and energy-based devices. It is not an injectable product, and you agree not to use it or represent it as an injectable biostimulator.

2.2 Intended Use:
You agree to use Porzellan® in accordance with its intended use, as outlined in product instructions and marketing materials. Any misuse, off-label use, or modification of the product that deviates from its intended purpose is prohibited and may result in loss of purchasing privileges.

3. Pricing and Payment

3.1 Pricing Structure:
Pricing is determined based on product quantities and is subject to change. The Purchaser will be informed of the current pricing at the time of order.

3.2 Payment Terms:
Payments for all orders must be made in full at the time of purchase unless otherwise agreed upon by both parties. Failure to pay on time may result in suspension of account privileges.

3.3 Taxes:
Purchaser is responsible for paying any applicable taxes on purchases, including sales tax and import duties where relevant.

4. Shipping and Delivery

4.1 Shipping Policies:
All orders will be shipped to the shipping address provided by the Purchaser. Porzellan is not responsible for any delays, damage, or loss of product caused during shipping. Tracking information will be provided upon shipment.

4.2 International Shipping:
At this time, Porzellan® ships only within the United States. International shipping may be considered in the future. However, purchasers in foreign markets are responsible for all duties, taxes, and compliance with local regulations.

5. Returns and Refunds

5.1 Return Policy:
Due to the professional-grade nature of the product, returns are only accepted in cases of damage or defect, and only within 30 days of receipt. Returned products must be unused and in their original packaging.

5.2 Refunds:
Refunds for defective products will be processed upon receipt of the returned items and verification of the defect. No refunds will be issued for products used in an unintended manner.

6. Account Access and Security

6.1 Account Security:
Purchasers are responsible for maintaining the confidentiality of their account login information. You agree not to share your access with unauthorized individuals or entities.

6.2 Account Termination:
Porzellan reserves the right to terminate or suspend accounts that violate these Terms and Conditions or for fraudulent activity.

7.1 Intellectual Property:
All product images, trademarks, and marketing materials provided within the professional portal are the property of Porzellan and its affiliates. You agree to use these materials solely for promoting Porzellan® products to your patients and not for unauthorized use or reproduction.

7.2 Marketing Use:
By accessing and using the provided marketing materials, you agree to accurately represent Porzellan® in compliance with all applicable laws and regulations.

8. Limitations of Liability

8.1 Product Use Liability:
Porzellan® is not liable for any injury, damage, or adverse outcomes resulting from the improper use or misuse of its products. By purchasing, you agree to follow the recommended usage guidelines and assume full responsibility for your professional practice.

8.2 Indemnification:
You agree to indemnify, defend, and hold harmless Porzellan, its affiliates, and employees from any claims, liabilities, damages, or legal expenses arising out of your improper use of Porzellan® products.

9. Governing Law

This agreement shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of laws principles. Any disputes arising from this agreement will be resolved exclusively in the courts of Delaware.

10. Changes to Terms

Porzellan reserves the right to update or modify these Terms and Conditions at any time without prior notice. Continued use of the professional portal and purchases of Porzellan® products constitutes your acceptance of the updated terms.
